January 4th, 2011
Not yet back to classes, but definitely back to schoolwork.

I’ve had a pretty fun break, spent a lot of time with family and friends, gotten some stuff done around the house…and now it’s hitting me that I really haven’t done much with any of my law review or moot court stuff this break. I’m planning to spend the next week working on my law review research (I have until February 6 to complete my first draft…only 30 pages…), and my moot court research.

Our Keenan moot court problem was released on December 30: whether under the Drug Price Competition and Patent Term Restoration Act and the doctrine of federal preemption, generic drug manufacturers can be held liable under state law for failing to strengthen the warnings in the labeling for the generic drug. At this stage in the game, I really have no idea what that means. I’m quickly learning that law school doesn’t so much teach you “the law”; rather, it serves to give you a basic foundation, such that you then have the tools to learn the particular areas of law that you will need in a given situation. At least that’s how I like to think of it.

My plan is to spend the first half of the week on law review (because I’m planning to meet with my law review advisor on Wednesday), and then spending the second half of the week thinking about this moot court problem. Yikes.

It is oh so important for me to be diligent about getting this co-curricular stuff done in a timely manner because I have a really busy schedule this semester. I am taking sixteen credits, spread over my co-curriculars and four classes: criminal law, constitutional law, trial practice, and federal jurisdiction. I will be on campus Monday through Thursday: nice, short 1.5 hour days on M/W; four hour evenings on Tuesdays; and long, late days on Thursdays (2-9:30pm). Thank goodness for Fridays. This will also be the first time in my life that I will have classes going later than 6pm, so this should be interesting.

I hope everyone had a wonderful holiday season…best wishes for the new year!!
