Professor Toth has served as the chief appellate counsel for Sommers, Schwartz P. C. for over 40 years. In this role he has litigated several hundred appeals involving a wide range of legal issues, but with a primary emphasis on personal injury and medical malpractice matters. He has briefed and argued innumerable motions before the Michigan Circuit Court, U.S. District Court for the Eastern District of Michigan, Michigan Court of Appeals, Michigan Supreme Court and the U.S. Circuit Court of Appeals for the Sixth Circuit.
As an active member of the Michigan Association for Justice (MAJ) he serves on the MAJ Amicus Committee and the MAJ Legislative Committee. On behalf of the MAJ, he has prepared and filed several amicus curiae briefs in the Michigan Supreme Court, generally relating to significant medical malpractice issues.
He has published several articles relating to medical malpractice, including co-authoring the article “Standard of Care in Michigan: A Plaintiffs Perspective” for the Michigan State Bar Journal and assisted his fellow partners, Stanley Schwartz and Norman Tucker, in the preparation of the legal text “Handling Birth Trauma Cases", a leading treatise in this field of law.
