Debtor-Creditor Relationships (3140)

This course covers the rights of creditors under state law, with particular emphasis on the enforcement of judgments through use of the writs of execution and garnishment, as well as the defenses of debtors, including those developed under federal procedural law. It will review the process of collection, liquidation and distribution of the estate of a bankrupt debtor, stressing the relationships of state secured transaction law to the Bankruptcy Code as well as the substantive and procedural law of bankruptcy and reorganization proceedings.
